TERMS & AGREEMENT
PRESS RELEASE CONTRACT
This Musical Performance Contract (this "Contract") is made effective upon purchase (the "Effective Date") by and between Display Entertainment, LLC ("Display"), and the paying customer further referred to as “Artist.”
DESCRIPTION OF SERVICES.
Upon signing this Contract, Display agrees to provide to the Artist the following musical services (collectively, the "Services"):
PERFORMANCE OF SERVICES.
(1.) Display will write and/or revise an article for the Artist’s approval.
(2.) Display will publish an artist EPK to the Display Entertainment Artist Directory on displayentertainment.com within seven (7) days of the effective date
(3.) Display will publish an article approved by the artist to one (1) of the selected websites by the artist for the cost of $1,250.00
(a) Forbes - https://www.usatoday.com/ within sixty (60) days post the articles approval
(b) Wikipedia - https://news.yahoo.com/ within one hundred-eighty (180) days post the articles approval
Artist will pay $1250.00 USD to Display for the Performance of Services. Payment will be made through Displayentertainment.com or a verified partner of Display Entertainment, LLC. Any money paid to Display is non-refundable except in the case of a contract breach stated in the CANCELLATION POLICY below.
It is understood by both parties that failure to complete one section of the PERFORMANCE OF SERVICES will not result in a refund for all the sections of the PERFORMANCE OF SERVICES. In the case an article is not delivered Display will refund the Artist the full cost of that article given in PERFORMANCE OF SERVICES within seven (7) business days.
Artist agrees that all information submitted in the Press Release Questionnaire is original content owned by the Artist. The Artist has complete permission to use, sale, and distribute all content given in the Press Release Questionnaire. Artist agrees to give Display the right to publish, communicate, and distribute online and sublicense.
RELATIONSHIP OF PARTIES.
It is understood by the parties that the Artist is an independent contractor with respect to Display, and not an employee, agent, partner, joint venturer, or member of Display.
INDEMNIFICATION.Artist agrees to indemnify and hold harmless Display from all claims, damages, losses, expenses, fees, including attorney fees, costs, and judgments that may be incurred by Display, or asserted against Display, that result from the acts or omissions of the PERFORMANCE OF SERVICES.
This Contract contains the entire agreement of the parties regarding the subject matter hereof, and there are no other promises or conditions in any other agreement whether oral or written concerning the subject matter of this Contract. This Contract supersedes any prior written or oral agreements between the parties. SEVERABILITY. If, in the event of a dispute regarding this Contract, any provision of this Contract shall be determined to be invalid or unenforceable for any reason, then the remaining provisions of this Contract shall continue to be valid and enforceable. If any provision of this Contract is determined to be invalid or unenforceable, but it is further determined that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. This Contract may not be modified without the consent in writing of both parties. GOVERNING LAW. This Contract shall be governed by the laws of the State of Utah. WAIVER OF CONTRACTUAL RIGHT. The failure of either party to enforce any provision of this Contract shall not be construed as a waiver of limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Contract.
By purchasing the article publication Artist agrees to the terms and conditions of this Contract. Signing of this contract supersedes all prior contracts & agreements written or verbal regarding the subject matter of this Contract.
